Prison for hacking and spamming

"I would suggest that the introduction of anti-virus programmes and firewalls should be compulsory for the IT systems of public institutions. This would help the Romanian companies producing security programmes," said Varujan Pambuccian, chairman of the IT&C Parliament Commission.

Romanian authorities next spring will initiate a bill punishing network criminality, Varujan Pambuccian told Ziarul Financiar.

The law will aim to punish wrongdoers introducing viruses, spying programmes and IT worms (viruses spreading by e-mail). People fraudulently cracking web sites or voluntarily avoiding the security systems will also be punished.

The law will also punish all the authors of carding activities (stealing from the credit cards or creating some virtual card numbers to use them in the electronic commerce) and the crimes on auction sites.

This last stipulation will aim at all the criminals who start an auction on a particular site and do not deliver the product for the money sent by the buyer.

Last, but not least, the law against network criminality will be applied against those guilty of financial crimes; "I do not specify what kind of financial crimes, for I do not want to give them ideas," Varujan Pambuccian said.

The charges against those found guilty of the above-mentioned crimes are penal and will be settled "by comparison and relatedness to the charges included in the Penal Code."

The electronic commerce Law, which has been endorsed by the Chamber of Deputies this week, stipulates that "any unauthorised access into an IT system or domain - defined as an area of an IT system owned by a natural or legal person -is punished by prison from 3 months to 3 years."

The unauthorised access into an IT system or network will be proved by tracking, namely following the web destinations visited by one particular person. Tracking will be done randomly or specifically, in case an IT crime has occurred.

"One who destroys a web site may be facing up to 25 years of prison," the chairman of the IT&C Commission said.

The electronic commerce Law also includes charges for spamming, namely written e-mails sent to an addressee that did not express the wish to receive them, while any consumer whose e-mail box is assaulted by commercial messages may sue the company having sent them.

Spamming is not regulated in Romania yet, but will be fined by 250 million ROL, according to the electronic commerce Law.

"I have suggested that fines should be expressed in euro, so that the amount does not devaluate as the time passes," Pambuccian said.

The law against network criminality will aim at those attacking the network from the inside. "Most frauds and IT crimes are committed inside the respective company," the official added.

The law will punish both the authors and the spreaders of viruses. Pambuccian said that the state should find a way to repay those catching the hackers so that the law should be efficient.
