Labor Code leaves no room for abuse by employers

Employers will not be able to make up projects in order to turnpermanent employment contracts into fixed-term contracts and thepublicity around Labor Code modification has had dramatic touches,which were uncalled for, believes Şerban Pâslaru, the partner incharge of the labor law department with Ţuca Zbârcea &Asociaţii law firm.

"Modifications made to the labor law are aimed at the labormarket and this time they are key modifications changing things inessential areas. The rule has been and will be that of sealingopen-ended contracts, despite the changes endorsed in theimplementation of fixed-term contracts", said Pâslaru during aworkshop on the changes made to the new Labor Code.

Though some discussions on the new Labor Code started from thepremise that employers will exploit the possibility of sealingfixed-term contracts, Pâslaru says that this type of contracts isstill sealed for jobs designed to help fill temporary needs.

"Employers will not be able to make up projects to hire onfixed-term contracts, they must pay attention to the situationsthat could be viewed as an abuse of rights. (...)", saidPâslaru.
